Man serving life term for murder acquitted

STATESMAN NEWS SERVICE   Kolkata, 24 December  

Mr Jagat Sarkar who has been serving a life imprisonment on a murder charge has been acquitted by the Division Bench of Mr Justice Aniruddha Bose and Mr Justice Shib Sadhan Sadhu of Calcutta High Court today. 

There is no proof of the crime to pronounce a life term, the court observed. 

The blame for the crime appears to have been foisted upon the accused, it was observed. 

He had been in prison for all these years owing to the negligence of the investigating officer,  it was further observed.  

Mr Sarkar who had been accused of killing Shakti Chakraborty was given a life sentence by the additional district judge, Fast Track Court, Howrah in May 2005. 

The accused had surrendered at Bali police station  after the crime and was subsequently arrested on April 2004, the prosecuting counsel had submitted during the trial.  

The accused had also offered to take the men in uniform to the corpse, it was further submitted. 

Mr Sarkar had appealed against the conviction. 

There is no eye-witness to the incident, Mr Jayanta Narayan Chatterjee submitted appearing for Mr Sarkar. 

Locals had discovered the body with the weapon which is contrary to the police's version of the incident, it was further submitted.

Rape accused to marry victim in jail today

JAIPUR: The new year is ringing happiness to a 26-year-old youth who was lodged in the central jail here on charges of rape. On Christmas day, the jail will witness the nikaah ceremony of the undertrial prisoner with the girl who had implicated him in a rape case on October 6.

While hearing a bail application of an undertrial prisoner, Mohsin Khan, lodged atJaipur central jail, Justice KS Ahaluwalia of Rajasthan high court allowed the prisoner to marry the girl in the jail. The girl's family has also consented over it.

The jail authorities were directed to allow two witnesses each from the prisoner and girl's side and 1 qazi for the nikaah ceremony which would be organised at the office of superintendent of jail.

"The inmate Mohsin Khan (26) was arrested by Transport Nagar police after a case of rape was lodged by the mother of the girl on October 6. The mother had said in the complaint that her daughter was raped allegedly by Mohsin on the promise of marrying her," said Nawab Ali Rathor, counsel for Mohsin on Tuesday.

"The girl in her statements before the magistrate had also stated that the accused had promised to marry her and thus made physical relationship," Rathore added.

Thus, Mohsin while applying for bail application some days ago, contended before the court that he never opposed to marry the girl and was always willing for the marriage. On these grounds we had filed a bail application before the court.

"The court also sought the consent of the girl and her family and allowed my client to marry the girl. The court has further directed the jail authorities to arrange for the nikaah ceremony to be held on December 25 within the jail. The court has given January 2 as the next date of hearing of the bail application of my client," Ali added.

The prisoner will also have to submit the nikaah certificate while the bail application would be heard on January, 2.

Meanwhile, jail authorities said that they will abide by the directions of the high court. "We will allow 1 qazi, 2 witnesses each from the girl and prisoner's side and the nikaah ceremony will be held at my office," said Pramod Sharma, jail superintendent, Jaipur.

Rape cases increase by 70% in three years ( news from times of india ) 

UDAIPUR: Crimes against women are on an upsurge in the state, reveals the statistics of police. The major crimes against women include rape, kidnap, abduction, homicide for dowry, torture, molestation, sexual harassment and trafficking.

Except for dowry deaths, cases of all the other types have increased significantly in the last three years with eve teasing cases topping the chart with an alarming 85.17% increase. There were 1,976 cases of eve teasing in 2011 that increased to 3,569 till September 2013.

There has also been a rise in the number of rapes. In 2011, a total of 1,468 rape cases had been registered in the state and by September this year, the number touched 2,505 cases, which is a 70.64% increase. Similarly, figures indicate a rise in kidnap and abduction cases by more than 47% this year compared to 2011 data.

Domestic violence cases registered under Section 498-A have also witnessed a huge increase with figures touching the mark of 12,000 this year when the number was below 10,000 two years back. The only category that gives some relief is dowry deaths, where the number has decreased by 11.5% compared to 2011.

Overall crimes against women have increased by 38% in the last three years in the state which portrays a sorry state of affairs for the weaker gender despite regulations getting stricter. Case studies indicate poorer sections of society and minors as prime targets of rape. Psychoanalysts believe that the conditions in which this social strata lives makes them vulnerable to inducements. Alarmingly, in almost 90% of the cases offenders were known to the victims and those involved included family members, relatives, neighbours or friends.

Recent incidents

A 21-year-old college student was arrested for allegedly raping a 14-year-old girl in Udaipur on December 14, 2013. The victim and the accused were neighbours and the latter had persuaded the girl to visit his rented flat on the pretext of uploading content on his laptop.

A Jaipur girl, 10, was allegedly raped by her stepfather in Mansarovar's Pitambar Nagar on November 12 this year.

A seven-year-old girl was raped by two men on Jan 19, 2013. The girl was found bleeding and unconscious in Matsya Industrial Area in Alwar town.

A female was subjected to sexual assault, rape and blackmailing by a man she got friendly with after few telephonic conversations. The accused, who was arrested on December 15 in Udaipur, had acquired gold ornaments worth lakhs from the victim by threatening to broadcast her obscene videos on social networking sites.

Rape charges by married women need harsher scrutiny: HC

KOCHI: Pointing out that in normal circumstances the testimony of a rape survivor would suffice for conviction, the Kerala high court ruled that courts should, however, insist on corroboration if the survivor is a married woman and there isn't enough medical evidence. 

The court was considering an appeal by Baburaj K of Aroor, who was convicted for raping a married woman. In his judgment last Thursday, Justice P Bhavadasan said, "The courts have been cautioned that in the case of a married woman, if she comes forward with an allegation of rape, and when the medical evidence is not of much help at all, it may be proper for the court to insist for corroboration. However, that too depends upon the facts of each case." 

The accused in the case considered by the HC was convicted to 10 years rigorous imprisonment by a sessions court for raping his neighbour, a 40-year-old married woman with two kids. At the trial court, the accused claimed that following a rumour in their locality that he had an illicit relationship with the victim, he had been falsely implicated in the case. 

The HC set aside the conviction citing discrepancies in the victim's oral testimony and hospital records. "It (victim's testimony) should not leave any doubt in the mind of the court as to what is spoken to by the victim is true. It is possible that there may not be any corroborative evidence or medical evidence in support of the allegation of rape. But the position is different when a married woman comes forward with an allegation of rape and no satisfactory explanation is offered for the delay in lodging the complaint. Unlike in the case of a virgin victim, the case of a married woman stands on a different footing," the HC judgment said.

JUDGMENT

Shiv Narayan Dhingra, J.

1. This petition under Section 482 of Cr.P.C. has been made on behalf of petitioner for quashing/setting aside the order dated 20th July, 2006 passed by learned Additional Sessions Judge, Delhi whereby the learned ASJ upheld the order of the Trial Court discharging appellants Bishan Pal Singh, Smt. Santosh Devi, Gajendar Singh and Toshan Singh. Bishan Pal Singh is the father-in-law of the complainant, Smt. Santosh Devi is the mother-in-law of complainant and Gajender Singh and Toshan Singh are the brothers-in-law (husband's brothers) of the complainant. The complainant made allegations involving almost every member of the family of her in laws. Learned Metropolitan Magistrate, after going through the evidence observed as under:

Perusal of record shows that the allegations of the complainant are against the accused person except the accused husband with respect of taunting for bringing insufficient dowry. But there is not a single allegation that the accused persons made any subsequent demand for dowry and consequent harassment for not meeting with their demands. Admittedly the complainant and her husband and in laws of the complainant were staying at Ghaziabad. Whereas the complainant most of the time resided with her husband at Riwari. It was held in AIR 1996(Supreme Court) 67 that taunting for not bringing sufficient dowry is distinct from demand of dowry and should not be confused with. Though taunting for bringing insufficient dowry is also an uncivilized act but does not come within the purview of Section 498A, sufficient to constitute the offence i.e. the cruelty to the complainant with respect to not fulfilllment of demand of of dowry. There is not a single allegation that except for the alleged taunting the complainant was ever harassed with respect to further demand of dowry. Hence the prima facie case under Section 498A is not made out against accused Bishan Pal, Santosh Devi, Gazender Singh and Kaushan Singh.

2. Against this order, the petitioner preferred a revision petition before the Court of Sessions and the learned Sessions Judge after considering the entire material observed as under:

In the present case, husband, Yashwant Singh, after marriage was residing separately from his parent and brothers. He was residing at Rewari, Haryana. The Ld. Trial Court found that allegation of the complainant are against the husband only. There were no specific allegations against the accused persons, namely, Bishan Pal Singh, Smt. Santosh Devi, Gajender Singh and Toshan Singh. The Ld. Trial Court was of the opinion that there was not even a single allegation that the accused persons made any subsequent demand of dowry and harassed the complainant for not fulfillling their demand. The complainant most of the time was residing with her husband at Rewari, Haryana. There might have been one or two instances of taunting for not bringing sufficient dowry but they are not sufficient enough to attract Section 498A. There are not specific allegations with respect to entrustment of dowry items to the accused persons. Since, the complainant stayed with her husband at Rewari, Haryana, the entrustment of dowry articles can be presumed to be to the husband. There were no specific allegations of entrustment to the accused person, namely, Bishan Pal Singh, Smt. Santosh Devi, Gajender Singh and Toshan Singh.

A perusal of the complaint would show that as per allegations dowry demand was made even before marriage i.e. at the time of engagement and an AC was demanded from her father by her in-laws and her father had assured that AC would be given at the time of marriage. However, she told her father You have given car and AC at the demand of in laws, what will happen if they demand a flat tomorrow?. Despite her this conversation with her father and despite her knowing that dowry demand had already been made, she married in the same family irrespective of the fact that she was well-educated lady and was an engineer and her brother was in police. In fact, these kinds of allegations made after breakdown of the marriage show the mentality of the complainant. I consider where these kinds of allegations are made, the police should simultaneously register a case under Dowry Prohibition Act (in short the 'Act') against the parents of the complainant as well, who married their daughter despite demand of dowry. Section 3 of the Act prohibits giving and taking of dowry. If a woman of grown up age and well educated gets married to a person despite dowry demand, she and her family becomes accomplaice in the crime under Dowry Prohibition Act.

4. Now-a-days, exorbitant claims are made about the amount spent on marriage and other ceremonies and on dowry and gifts. In some cases claim is made of spending crores of rupees on dowry without disclosing the source of income and how funds flowed. I consider time has come that courts should insist upon disclosing source of such funds and verification of income from tax returns and police should insist upon the compliance of the Rules under Dowry Prohibition Act and should not entertain any complaint, if the rules have not been complied with. Rule 2 of the Dowry Prohibition(Maintenance of List of Presents to the Bride and Bridegroom) Rules, 1985 reads as under:

2. RULES IN ACCORDANCE WITH WHICH LISTS OF PRESENTS ARE TO BE MAINTAINED.-(1) The list of presents which are given at the time of the marriage to the bride shall be maintained by the bride.

(2) The list of presents which are given at the time of the marriage to the bridegroom shall be maintained by the bridegroom.

(3) Every list of presents referred to in Sub-rule(1) or Sub-rule(2)-

(a) shall be prepared at the time of the marriage or as soon as possible after the marriage;

(b) shall be in writing;

(c) shall contain:

(i) a brief description of each present;

(ii) the approximate value of the present;

(iii) the name of the person who has given the present; and

(iv) where the person giving the present is related to the bride or bridegroom, a description of such relationship.

(d) shall be signed by both the bride and the bridegroom.

5. The Metropolitan Magistrates should take cognizance of the offence under the Act in respect of the offence of giving dowry whenever allegations are made that dowry was given as a consideration of marriage, after demand. Courts should also insist upon compliance with the rules framed under the Act and if rules are not complied with, an adverse inference should be drawn. If huge cash amounts are alleged to be given at the time of marriage which are not accounted anywhere, such cash transactions should be brought to the notice of the Income Tax Department by the Court so that source of income is verified and the person is brought to law. It is only because the Courts are not insisting upon compliance with the relevant provisions of law while entertaining such complaints and action is taken merely on the statement of the complainant, without any verification that a large number of false complaints are pouring in.

6. I consider that the kinds of vague allegations as made in the complaint by the petitioner against every member of the family of husband cannot be accepted by any court at their face value and the allegations have to be scrutinized carefully by the Court before framing charge. A perusal of the complaint of the petitioner would show that she made all kinds of allegations against her husband regarding beating, that her husband was having illicit relationship with 35 girls; he forced her to write suicide note, abused her, taunted her, threatened and told her that he was getting another bride of more richer family while she was in Rewari with her husband and she made telephone call to her parents who came to Rewari and took her to parental home. She had also given phone to one of her friends Jigyasa. A perusal of the statement of Jigyasa would show that she told Jigyasa that it was her husband who was torturing her and behaving with cruelty. However, in her complaint, she made vague and omnibus allegations against every other family members. The statement made by her and other witnesses have been scrutinized by me, except vague allegations and allegations of taunting, there are no allegations of perpetuating cruelty on her by any of the four respondents in order to compel her to bring more dowry or any particular items.

7. In view of my foregoing discussion, I find no reason to disagree with the order of two Courts below. The petition is hereby dismissed being devoid of merits.

இவர்களின் அட்டூழியங்கள் அத்து மீறி சகிக்க முடியாத நிலைக்கு செல்லும்போது, அதை வெளிப்படையாக எழுதியே தீர வேண்டும். அப்படி எழுதியே தீர வேண்டிய நேர்வு, சமீபத்தில் பரபரப்பாக விவாதிக்கப்பட்டுக் கொண்டிருக்கும் தேவயானி கோபராக்கடேக்கள் பற்றியது.  தேவயானி கோபராக்கடேவின் தந்தை உத்தம கோபராக்கடே, மஹாராஷ்டிர மாநிலத்தைச் சேர்ந்த ஐஏஎஸ் அதிகாரி. அவர் ஒரு தலித்.  தமிழகத்தை விட, மராட்டிய மாநிலத்தில் தலித்துகளின் எழுச்சியும், வீச்சும் அதிகம்.  பெரிய அளவில் தலித் அரசியல் வெற்றி பெறாத தமிழகத்திலேயே அதிகாரிகளில் தலித் லாபி இத்தனை அதிகாரத்தோடு இருக்கையில், மராட்டிய மாநிலத்தைப் பற்றி சொல்ல வேண்டியதில்லை. அந்த வகையில் உத்தம் கோப்ராகடே மிக மிக செல்வாக்கான ஐஏஎஸ் அதிகாரியாக விளங்கினார்.  மஹாராஷ்டிர மாநிலத்தின் முதல்வராக இருந்த சுஷில் குமார் ஷிண்டேவோடு உத்தம் கோப்ராகடே மிக மிக நெருக்கம்.  இந்த நெருக்கத்தின் விளைவை பின்னால் பார்க்கலாம். உத்தம் கோபராகடே 1999ம் ஆண்டு சிவில் சர்வீசஸ் தேர்வில் இந்திய வெளியுறவுப் பணிக்கு தேர்ந்தெடுக்கப்படுபவர் மகாவீர் சிங்வி.  இவரோடு சிவில் சர்வீஸ் தேர்வுக்காக படிப்பவர் அர்லீன் சத்தா என்ற பஞ்சாபிய பெண்ணும் படிக்கிறார். வெளியுறவுப் பணியிக்கு தேர்ந்தெடுக்கப்பட்டதும் சிங்வி அடிப்படை பயிற்சியை முடிக்கிறார்.  பயிற்சியில் 73 சதவிகித மதிப்பெண் பெற்று தேர்ச்சியடைகிறார்.  வெளியுறவுப் பணி அதிகாரிகளுக்கான பயிற்சி மையத்தில் பயிற்சியை முடித்து 97 சதவிகித மதிப்பெண் பெறுகிறார்.  வெளியுறவுப் பணிக்காக தேர்ந்தெடுக்கப்பட்டவர்களின் வரிசையில் மகாவீர் சிங்வி 5வது இடத்தில் இருக்கிறார். ஐஏஎஸ் தேர்ச்சி பெற்றவர்களுக்கு, மாநிலம் ஒதுக்குவது எப்படி அவர்கள் பெற்ற மதிப்பெண்கள் அடிப்படையில் நிர்ணயம் செய்யப்படுகிறதோ, அதே போல இந்திய வெளியுறவுப் பணியில் மொழி ஒதுக்கீடு மதிப்பெண்கள் அடிப்படையில் வழங்கப்படுகிறது.  அந்த ஆண்டு வெளியுறவுப் பணிக்கு தேர்ச்சி பெற்றவர்களில் மகாவீர் சிங்வி ஐந்தாவது இடத்தில் இருக்கிறார்.  ஒதுக்கப்பட வேண்டிய மொழிகளில் ப்ரென்ச் மொழியில் இரண்டு காலியிடங்கள். ஜெர்மன் மொழியில் ஒரு காலியிடம்.  ரஷ்ய மொழியில் இரண்டு காலியிடங்கள்.  சீன மொழியில் ஒரு காலியிடம். ஸ்பானிஷ் மொழிக்கு ஒரு காலியிடமும், அராபிய மொழிக்கு இரண்டு காலியிடங்களும் இருக்கின்றன.  மகாவீர் சிங்வி ஐந்தாவது இடத்தில் இருந்ததால், இவருக்கு முன்பாக இருந்த நான்கு அதிகாரிகளில் இருவர் ப்ரென்சு மொழியையும், ஒருவர் ரஷ்ய மொழியையும், ஒருவர் சீன மொழியையும் தேர்ந்தெடுக்கிறார்கள்.  சிங்வி தன் விருப்பத்தை வரிசையின் படி, ப்ரென்ச்சு, ஜெர்மன், அராபி மற்றும் ஸ்பானிஷ் என்று விண்ணபித்திருந்தார். ஐந்தாவது இடத்தில் இருந்த சிங்விக்கு அவர் விரும்பியபடி அவரது இரண்டாவது தேர்வான ஜெர்மன் மொழி ஒதுக்கப்பட்டிருக்க வேண்டும்.  ஆனால், 29.01.2001 அன்று, மகாவீர் சிங்விக்கு ஸ்பானிஷ் மொழி ஒதுக்கப்படுகிறது. அதிர்ச்சியடைந்த சிங்வி, உடனடியாக வெளியுறவுத் துறைக்கு கடிதம் எழுதுகிறார்.  அவர் கடிதம் எழுதிய உடனேயே, வெளியுறவுத் துறையில் இணைச் செயலராக இருந்த பி.எல்.கோயல் என்பவர் சிங்வியை அழைத்து, இந்த விவகாரத்தை இப்படியே விட்டு விடும்படியும், மேலே புகார் தெரிவித்தால் சிக்கலை சந்திக்க நேரிடும் என்றும் எச்சரிக்கிறார்.  1999ம் ஆண்டு முதல், மொழி ஒதுக்கீட்டில் புதிய முறை கையாளப்படுவதாகவும் தெரிவிக்கிறார். சிங்வி தேர்ந்தெடுத்த அதே ஆண்டில் வெளியுறவுத் துறை பணிக்கு தேவயானி கோபராக்டே தேர்ந்தெடுக்கப்பட்டதும், அவர் தந்தை மகாராஷ்டிர மாநிலத்தில் மிகப்பெரிய செல்வாக்கு படைத்தவர் என்பதும் அப்போதுதான், சிங்விக்கு தெரிய வருகிறது. அந்த ஆண்டு மாற்றப்பட்ட மொழி ஒதுக்கீட்டு முறையின்படி, ஐந்தாவது ரேங்க் எடுத்த சிங்விக்கு, அவர் கடைசியாக தேர்ந்தெடுத்த ஸ்பானிய மொழி ஒதுக்கீடு செய்யப்பட்ட வினோதமான முறையை எதிர்த்து முறையீடு செய்ய முயன்ற சிங்வியை வெளியுறவுத்துறை இணைச் செயலர் நேரில் அழைத்து மிரட்டுகிறார்.   சிங்வி இது குறித்து சற்றும் கவலைப்படாமல் 31.01.2001 அன்று இந்த அநியாயத்தை எதிர்த்து வெளியுறவுத் துறை செயலருக்கு மனு ஒன்றை அளிக்கிறார். இரண்டு நாட்களில் டெல்லி பதிப்பு டைம்ஸ் ஆப் இந்தியா நாளிதழில் முறையற்ற மொழி ஒதுக்கீடு குறித்து செய்தி வருகிறது. இது வெளியுறவுத் துறை அதிகாரிகளை கடும் கோபமடையச் செய்கிறது. சிங்வி அளித்த மறு நாளே, சிங்வியின் ஆண்டறிக்கையில் (Annual Confidential Report) சிங்வி ஒரு ஒழுங்கீனமான அதிகாரி என்று காரணமே இல்லாமல் ஒரு பதிவு செய்யப்படுகிறது. இந்த நேரத்தில் சிவில் சர்வீசஸ் தேர்வுகளில் சிங்வியோடு படித்த அர்லீன் சத்தா என்ற பெண்மணி, தன்னை திருமணம் செய்து கொள்ளுமாறும், அப்படி செய்யாவிட்டால் அவர் வேலைக்கே உலை வைப்பேன் என்றும் மிரட்டுகிறார். இந்த மிரட்டல்கள் தொடர்ந்து நடந்து கொண்டிருந்ததால், அர்லீன் சத்தா என்ற பெண்மணியும், அவர் குடும்பத்தினரும் தன்னை திருமணம் செய்து கொள்ளும்படி மிரட்டுவதாக சிங்வி புகார் அளிக்கிறார்.   சிங்வியின் இந்தப் புகார், வெளியுறவுத் துறை அதிகாரிகளுக்கு அல்வா போல கிடைக்கிறது. வெளியுறவுத் துறை அதிகாரிகள், அர்லீன் சத்தாவை சிங்வி மிரட்டுகிறார் என்று புகார் அளிக்கும்படி, அர்லீன் குடும்பத்தாரிடம் அறிவுறுத்துகின்றனர் வெளியுறவுத் துறை அதிகாரிகள். அதன் படியே, அர்லீனின் தாயார் நரீந்தர் சத்தா புகார் அளிக்கிறார்.  சிங்வி தன் மகள் அர்லீன் சத்தாவையும், அவரையும் தொடர்ந்து மிரட்டுவதாக புகார் அளிக்கிறார். அந்தப் புகார் வெளியுறவுத் துறையில் உள்ள விஜிலென்ஸ் பிரிவுக்கு விசாரணைக்காக அனுப்பப் படுகிறது. விசாரணை நடத்திய இணைச் செயலர் ஒருவர், அர்லீன் சத்தாவை, சிங்வி மிரட்டுவதாக கூறிய சமயத்தில் வெளியுறவுத் துறை பயிற்சி நிலையத்தில் சிங்வி பயிற்சியில் இருந்ததாகவும், அந்த சமயத்தில் அவர் மீது ஒழுங்கீனமான நடத்தை குறித்து எந்தப் புகாரும் இல்லை என்றும், அவர் சரியானபடியே நடந்து கொண்டார் என்றும் குறிப்பிடுகின்றனர். ஆனால் மறுநாளே வெளியுறவுத் துறையில் உயர் அதிகாரிகள் கலந்து கொண்ட ஒரு கூட்டம் நடந்து, அந்தக் கூட்டத்தில் சிங்வி ஒழுங்கீனமான அதிகாரி என்றும், அவர் மீது விசாரணை நடத்த வேண்டும் என்றும் முடிவெடுக்கப்படுகிறது. விசாரணை நடத்தப்பட்டு மத்திய விழிப்புப் பணி ஆணையத்திடம் அறிக்கை அளிக்கப்படுகிறது.  அந்த அறிக்கையில், உயர் அதிகாரிகள் அத்தனை பேரும் ஏக மனதாக எடுத்த முடிவின் அடிப்படையிலும், இந்திய வெளியுறவுத் துறை அமைச்சர் எடுத்த முடிவின் அடிப்படையிலும் மகாவீர் சிங்வியை பணி நீக்கம் செய்வதென முடிவெடுக்கப்பட்டுள்ளது. அரசு ஊழியர் மீது எந்தப் புகார் வந்து விசாரணை நடத்தப்பட்டாலும், அவர் மீதான குற்றச்சாட்டுகள், அதற்கான ஆதாரங்கள் அனைத்தும் அவருக்கு வழங்கப்பட்டு, அவர் தரப்பு பதிலைக் கேட்டுப் பெற வேண்டும்.  முழுமையான விசாரணை, குறுக்கு விசாரணை ஆகியவை நடந்த பிறகே, அவர் மீது நடவடிக்கை எடுக்க இயலும்.  ஆனால், மகாவீர் சிங்வியைப் பொறுத்தவரை, அவருக்கு எந்த ஆவணங்களோ, புகார் நகலோ, விசாரணை அறிக்கையின் நகலோ வழங்கப்படாமலேயே, 13.06.2002 அன்று அவர் பணி நீக்கம் செய்யப்படுகிறார். இவரை பணி நீக்கம் செய்ய பரிந்துரைத்த அந்த அலுவலகக் கோப்பில், ஒரு உயர் அதிகாரி இவ்வாறு எழுதுகிறார் "சிங்வியின் மொழி ஒதுக்கீடு, பயிற்சி காலம், தற்போது அவர் மீது வந்துள்ள புகார் ஆகியவற்றை வைத்துப் பார்க்கையில், இனியில் அவர் வெளியுறவுப் பணியில் தொடர்ந்தாரேயென்றால், அவர் இந்தியாவின் பெயரையே களங்கப்படுத்தி விடுவார்.  இனியும் நாம் அவரை பணியில் தொடர அனுமதிக்கக் கூடாது"  இப்படி எழுதுகிறார் வெளியுறவுத்துறை அதிகாரி ஜெயந்த் பிரசாத். இந்த பணி நீக்க உத்தரவை எதிர்த்து மத்திய நிர்வாகத் தீர்ப்பாயத்தில் வழக்கு தொடுக்கிறார் மகாவீர் சிங்வி.  அவரை பணி நீக்கம் செய்தது சரியே என்று தீர்ப்பளிக்கிறது நிர்வாகம்.  அத்தீர்ப்பை எதிர்த்து டெல்லி உயர்நீதிமன்றத்தில் மேல் முறையீடு செய்கிறார் சிங்வி.  அவர் பணி நீக்கம் செய்யப்பட்டதை ரத்து செய்து உத்தரவிடும் டெல்லி உயர்நீதிமன்றம், தனது தீர்ப்பில் கீழ் கண்டவாறு குறிப்பிடுகிறது. More than six years have already elapsed in seeking redressal. ஒரு மனிதனின் நம்பிக்கைக்குரிய அரசுப் பணி இன்று கேள்விக்குறியாகியிருக்கிறது.  மனுதாரர் பணியில் தொடர்ந்தால் இந்தியாவையே களங்கப்படுத்தி விடுவார் என்ற மத்திய வெளியுறவுத் துறை இணைச் செயலாளர் ஜெயந்த் பிரசாத்தின்  முடிவு அடிப்படையில்லாத முடிவு.  மிக மோசமான முன் முடிவெடுக்கப்பட்ட குறிப்பு அது.  ஒரு நாய்க்கு கெட்ட பெயர் ஏற்படுத்தி விட்டு, அதைத் தூக்கில் தொங்க விடு என்ற ஸ்காட்டிய பழமொழிக்கு ஏற்ப அது உள்ளது. ஒரு அரசு ஊழியரின் பணியையே அவர் வாழ்வையே, நாசம் செய்யக் கூடிய அளவிலான, உரிய வாய்ப்பளிக்காமல் நடக்கும் ஒரு சார்பான விசாரணைகளை தடுக்கும் நேர்வுகளில் இந்த நீதிமன்றமும், நாடும், வெகுவாக முன்னேறியிருக்கிறது. தன்னை பதவியை விட்டு நீக்கும்போது, இந்த மனுதாரர், தனது பணியின் ஆரம்பக்கட்டத்தில் இருந்தார். ஏறக்குறைய ஆறு ஆண்டுகள் கடந்து விட்டன" என்று கூறி, ஒரு மாதத்துக்குள், சிங்விக்கு முழுமையான பணியை அளித்து, இடைப்பட்ட காலத்துக்கான அனைத்து பயன்களையும் அளிக்க வேண்டும் என்று உத்தரவிட்டது டெல்லி உயர்நீதிமன்றம். இதை எதிர்த்து மத்திய வெளியுறவுத் துறை உச்சநீதிமன்றத்தில் மேல் முறையீடு செய்கிறது.  அந்த மேல் முறையீட்டு மனுவை தள்ளுபடி செய்த உச்சநீதிமன்றம், மேல் முறையீடு செய்த வெளியுறவுத் துறைக்கு 25 ஆயிரம் அபராதம் விதித்து, அந்த அபராதத் தொகையை சிங்விக்கு செலுத்த வேண்டும் என்று உத்தரவிட்டது. மகாவீர் சிங்வி செய்த ஒரே தவறு, மிக மிக பலம் பொருந்திய ஒரு தலித் ஐஎஃப்எஸ் அதிகாரியோடு மோத முயன்றதுதான். இன்று மாயாவதி, தேவயானி கோபரகாடே ஒரு தலித் என்பதால், அவர் இப்படி வஞ்சிக்கப்பட்டுள்ளார் என்று கூறுகிறார்.  விடுதலைச் சிறுத்தைகள் கட்சித் தலைவர் திருமாவளவன், "இந்திய துணை தூதர் தேவயானி அவமானப்படுத்தப்பட்ட விவகாரத்தில் அமெரிக்க வெளியுறவுத் துறை அதிகாரிகள் மீது உரிய நடவடிக்கை எடுக்க வேண்டும். இதில் அமெரிக்கா பிடிவாதமாக உள்ளது. அந்நாட்டுடான உறவை முறிக்க வேண்டும்" என்று கூறுகிறார்.  இதெல்லாம் எதற்கு என்றால், தேவயானி ஒரு தலித் அதிகாரியாம். தேவயானியெல்லாம் தலித் என்றால் அப்புறம் தலித்துகளை என்னவென்று அழைப்பது ?  வெளிச்சமும், உதவியும், ஆதரவும் தேவைப்படும் தலித்துகள், இந்தியா முழுக்க கோடிக்கணக்கில் இருக்கிறார்கள்.  அவர்களுக்கு எதிரான ஒடுக்குமுறையும் தொடர்ந்து கொண்டுதான் இருக்கின்றன. ஆனால், தேவயானி போன்ற போலி தலித்துகளே, தலித்துகளுக் குண்டான சலுகைகளை அபகரித்துக் கொண்டிருக்கிறார்கள்.    நியாயமாக இந்த சலுகைகள் சென்றடைய வேண்டிய தலித்துகளை சென்று அடைய விடாமல், தடுப்பவர்கள் தேவயானிகளே.  தேவயானி தலித் என்றால், அவர் ஒடுக்கப்பட்ட சமூகத்திலிருந்து வந்தவரென்றால், வறுமை காரணமாக நாடு விட்டு நாடு வந்து பணியாற்றும் வீட்டுப் பணியாளரிடம் கருணையோடல்லவா நடந்து கொண்டிருக்க வேண்டும் ? ஆனால் எப்படி நடந்து கொண்டிருக்கிறார் என்பது சங்கீதாவின் கணவர், பிலிப் டெல்லி உயர்நீதிமன்றத்தில் தாக்கல் செய்த மனுவில் தெரிவிக்கப்பட்டுள்ளது. தன் மனைவி சங்கீதாவோடு தொலைபேசியில் பேசியதை வைத்து அந்த மனுவை தாக்கல் செய்துள்ளார் பிலிப். சங்கீதாவை, தேவயானி நடத்திய விதம் ஒரு அடிமையை நடத்தியது போல இருந்தது. ஞாயிற்றுக் கிழமை விடுமுறை என்று ஒப்பந்தத்தில் இருந்தாலும், ஞாயிற்றுக் கிழமைகளிலும் சங்கீதா காலை 6 மணி முதல் இரவு 11 மணி வரை வேலை செய்தார். சர்ச் செல்வதற்கு மட்டும் 2 மணி நேரம் அனுமதி வழங்கப்பட்டது.  உத்தம் கோப்ராகடே எங்கள் குடும்பத்தை அடிக்கடி தொடர்பு கொண்டு மிரட்டுவார்.  எங்களை கடத்தி விடுவோம் என்றும், சங்கீதா அமெரிக்க அதிகாரிகளை தொடர்பு கொண்டால், பொய் வழக்கு போட்டு, போதை மருந்து கடத்தியதாக வழக்கு போட்டு நிரந்தரமாக சிறையில் தள்ளி விடுவேன் என்று மிரட்டினார். அமெரிக்க தூதரகத்தில் தேவயானி, சங்கீதா என் வீட்டிலிருந்து திருடினார் என்று பொய்க் குற்றச்சாட்டு கூறினார்.  என்ன திருடினார் என்று கூறியதற்கு, வீட்டுக்கு வந்தால் தெரியும் என்று மிரட்டினார். சங்கீதாவின் மகள் ஜெனிஃபர் தாக்கல் செய்துள்ள மனுவில், என் தாயாரிடம் எப்போது பேசினாலும் சோகமாகவே பேசுவார்.  இந்தியாவுக்கு திரும்பி விடுகிறேன் என்று என் தாய் சொன்னாலும் தேவயானி அனுப்ப மறுத்து விட்டார்.  உத்தம் கோப்ராகடே சொன்னதின் பேரில் எங்கள் வீட்டுக்கு நள்ளிரவில் 5 போலீசார் வந்தனர்.  அதன் பிறகு அடிக்கடி போலீசார் எங்களை போன் மூலம் தொடர்பு கொண்டு மிரட்டினார்கள்". பணிப்பெண் சங்கீதா மற்றும் அவர் கணவர் பிலிப்

Editor of Chennai-based Captain TV arrested in sexual harassment case

Chennai: The Editor of Captain TV, a Chennai-based news channel, has been arrested by the police following a sexual harassment complaint lodged against him by his former colleague. 

Sources in the police say the complainant who worked as a Sub-Editor with the channel was terminated from work a few days ago. 

Officials at Captain TV have denied the allegations against their Editor, Dinesh Kumar, and called the "false complaint" a "political conspiracy ".

They say Mr Dinesh had recently spearheaded a protest against the police, seeking action against a group that attacked a reporter of the channel. His arrest, they claim, is to avenge his action. 

Captain TV is owned by the family of actor Vijayakanth, who heads the DMDK party.

The arrest comes nearly three weeks after Traun Tejpal, the editor-in-chief of news magazine Tehelka, was arrested by Goa Policefor allegedly sexually assaulting a younger colleague.
