Blaming medical neglect, Delhi court junks dowry case
"The hospital's approach was not in consonance with the duty cast upon it. A valuable life was lost due to insufficient care taken by the hospital officials and therefore, the matter requires to be referred to the higher officials of the department to make an appraisal of working conditions in the hospital and to take suitable action in this regard," the court said. The victim's husband, and father-in-law Ram Gopal, were discharged by the court which also pulled up the Delhi Police for its faulty investigation in the case.
The incident took place on the intervening night of November 15-16, 2013, when the victim died at the GTB Hospital, where she was being treated for an alleged history of fever and inter-menstrual bleeding, because of not being taken to medicine emergency. The prosecution had alleged that the victim's in-laws deliberately did not take the woman to the emergency ward.
However, the court held that it was the hospital's duty to take care of the patient as she was admitted there. "Such presumption of IO and prosecution is ill-founded because the woman was taken to the hospital during midnight by her in-laws alone and therefore, there was no reason for them to deliberately omit to take her to medicine emergency," the court said.
After considering the woman's medical records, additional sessions judge Pulastya Pramachala said that the woman was not taken to the medical emergency despite specific instructions of the doctor who was treating her.
Discharging the duo, the court also noted that the victim's medical records revealed that she was also taken to a clinic for her illness by her mother-in-law on November 11, 2013 and the treatment prescribed by the clinic was followed. "In these circumstances, it cannot be presumed that in-laws of the victim deliberately did not provide medical assistance to her, by omitting to take her to a doctor or to the hospital," the court said.
The court referred the matter to the director general of health services, Government of India and secretary to the department of health services, government of NCT of Delhi. "I find it necessary to refer to a disturbing fact/scenario, which arises out of the case in hand. As per facts of this case, the lady has died probably because of insufficient medical attention given by the officials of hospital." The complaint in the case was lodged by victim's brother Himanshu who alleged that her sister died because of being tortured and harassed by her husband and in-laws.
