குடும்ப வன்முறைகள் நாட்டிலேயே தமிழகத்தில்தான் அதிகம் நடந்துள்ளது,'' என , மத்திய பெண்கள் மற்றும் குழந்தைகள் நல மேம்பாட்டுத்துறை அமைச்சர் கிருஷ்ணா தீரத் கூறினர்.லோக்சபாவில் அவர் கூறியதாவது:தேசிய குற்ற ஆவணப்பிரிவு, சமீபத்தில் வெளியிட்ட புள்ளவிபரப்படி, கடந்தாண்டில், நாடு முழுவதும் குடும்ப வன்முறைகள் வழக்குகள், 9,431 பதிவாகியுள்ளன. இதில், அதிக பட்சமாக தமிழகத்தில், 3,983 வழக்குகள் பதிவாகியுள்ளன. இதற்கு அடுத்ததாக, குஜராத்தில், 3,266 வழக்குகள் பதிவாகியுள்ளன.பள்ளிகள், கல்லூரிகளில் மாணவ, மாணவிகள் தற்கொலைகள் தொடர்பாக, தேசிய குழந்தைகள் உரிமை பாதுகாப்பு ஆணையம், 36 வழக்குகளை விசாரித்துள்ளது. இதில், தமிழகத்தில் அதிகபட்சமாக, 21 புகார்கள் பதிவாகியுள்ளன.இவ்வாறு அவர் கூறினார்.

In India, the quantum of alimony revolves around a mysterious  "standard of living" which the wife suddenly assumes just ONE day after she marries the husband !!!

She might have been a pauper all her life, she might be earning to maintain her maiden status, but becomes "suddenly accustomed" to a standard of a living of the husband, even IF it was just a short wedding !!

Then FOR THE REST OF HER LIFE the Indian husband is supposed to keep paying her alimony to maintain that standard of living !!!!  ...yes I am not joking....

Alimony per month is computed and then compounded to arrive at astronomical "limp sums" that men need to pay

Millions of Indian men do NOT understand this and are being lead to the gas chambers !!

In many cases EVEN if men loose their job, they aren't spared

Courts asked to focus on reuniting families

INDORE: "All the judges have been given instructions to stress on reuniting families and take efforts to avoid separation or divorce, even if there is one per cent possibility of rapprochement," said justice K K Lahoti of Madhya Pradesh high court here on Tuesday.

Lahoti said courts are asked to take cases related to marriage discord, divorce, maintenance, child custody, adoption and execution of court orders related to maintenance after divorce. Courts have also been empowered to take the help of counsellors to resolve issues related to marriage and divorce.

"Children are biggest sufferers of divorce or separation of their parents so main motive while resolving these cases should be to unite the family," Lahoti added.

Going by Justice K K Lahoti's observation, these cases, especially divorce cases involve issues of alimony where the husband is directed to pay certain amount as legal cost towards maintenance of his wife.

The bench decides the amount considering husband's income and lifestyle. Here one of the main factors includes whether the wife is a working lady, and if yes, whether her earnings are sufficient to sustain the style of living she is used to.

However if a woman claims higher alimony than man can afford, the court takes the right decision favouring the man.

He also remarked that though there has been no case until now where the husband claims for permanent maintenance after divorce, but in case such situation arises where the husband is unemployed and wife is earning, required measure would be taken to support him.

He clarified that women are entitled for maintenance after divorce even if she is working.

"If earning of working women is significantly low as compare to earning of husband and if she is not able to maintain the standard of life like she use to have with her husband. In this working women are also entitled for maitainance so that she can lead a standard of life as equivalent of her husband," said Lahoti.

Going by the records, there have been times where men use tactics to conceal their income, or quit their jobs to avoid paying high maintenance/alimony. The court, in such cases is suspicious enough to take note of these circumstances.

Govt's guidelines to prevent misuse of Sec 66

New Delhi, Nov 29 (PTI) Yielding to public protests on the recent controversial arrest of some persons for their Facebook posts, Government today came out with guidelines under which a police officer no less than the rank of DCP can sanction prosecution.

In metropolitan cities, such an approval would have to be given by officers at the level of Inspector General of Police (IGP).

Norway seeks jail for Indian couple for 'maltreating' son

New Delhi, December 01, 2012


An Indian couple in Norway has been charged with 'gross/repeated maltreatment' of their child by threats, violence and other wrong doing, under section 219 of Norwegian law, according to reports.

The prosecution has reportedly proposed a sentence of 1 year, 3 months for the mother, and 1 year, 6 months for the father of the child.

According to reports, the couple have been remanded to custody over fear that they will evade prosecution by returning to India.

The defence lawyers will appeal on Saturday.

On Friday, the Indian embassy in Oslo had sought details over the arrest of the couple for allegedly trying to discipline their son who was found wetting his pants.

According to reports, the embassy is also in touch with the couple's lawyer and is ready to provide necessary consular assistance to it.

V Chandrasekhar, a software professional from Andhra Pradesh's Krishna district working in Oslo, never imagined that he and his wife would be arrested by Norwegian Police for trying to discipline his 7-year-old son.

Chandrasekhar along with his wife Anupama was taken into custody by the police in Oslo for allegedly trying to discipline their son, their family here claimed.

The police arrested Chandrasekhar, a TCS employee nine months after the child complained to his school teachers that his parents were threatening to send him back to India for his acts, Chandrasekhar's nephew V Sailender claimed.

"My uncle had no idea about the case registered against him initially. He came to Hyderabad along with his wife and children in July and went back to Oslo in the last week of October. Then he was served a notice to appear before the authorities along with his wife," he said.

"My aunt also went to Oslo on November 23 and the couple appeared before the authorities concerned. On November 28, we were informed by my uncle's neighbours in Oslo that they were arrested and remanded," Sailender told PTI.

The boy was found urinating in the school bus which was reported to his father, who in turn "threatened" the child that he would be sent back to India if he repeated that again, Sailender said, adding the boy was also found bringing toys from school.

"We are yet to get complete details on Chandrasekhar's arrest," he said.

He said the boy was under the custody of Norwegian child protection authorities for some time in February to study his behavioural pattern.

Later, they found that the child was alright but 'hyper-active' and handed over him to parents," he said.

When contacted, a spokesperson of TCS confirmed the arrest but refused to offer comment, saying that it was a personal matter of the employee.

The Lawyer and cricket bat


I like what Papu (Delhi) once wrote about lawyers in matrimonial cases that husbands fight these days ..;

what he said is something *like this*

- remember you are the player, you make the strategy, you decide which ball to answer, you decide when to strike etc
