Yes cruelty is to be punished

What about the 98% false dowry cases where wife has filed false or frivolous cases ??? Will the courts order fine or imprisonment to the wife ????

Even in this case the wife filed a dowry case !!! So every matrimonial fight is converted to a dowry case and parents arrested and courts and police efforts wasted

Baseless infidelity charge is cruelty: HC

MUMBAI: Making baseless allegations of adultery against wife is mental cruelty, the Bombay HC said while holding a Mumbai resident guilty. Justice A R Joshi gave the husband an option; pay Rs 1 lakh as compensation or go to jail.

"In view of evidence and the allegations made against the character of (the wife), definitely it is a case in which there was a mental cruelty practised on (her)," said the judge. Nilesh Chauhan's plea to release him on a bond of good conduct was rejected by the court, saying doing so would be "misplaced sympathy".


Chauhan and Sheela married in 2002. But soon, they quarrelled as Chauhan accused her of having illicit relations. She later filed a dowry complaint.
