Heard learned counsels for the petitioner and the State.

The petitioner being the father of the husband of the informant is apprehending his arrest in a case registered for the offences punishable under Sections 498A, 323, 324, 379, 342/34 of the Indian Penal Code and 3/4 of Dowry Prohibition Act. The basic accusation is of torture for non- fulfillment of the dowry demand. 

It is submitted by learned counsel for the petitioner that the accusation is not specific against the petitioner and thrust of accusation is against the husband of the informant.

Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail in the event of his arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM, Jhanjharpur, District - Madhubani in connection with Phulparas P.S. Case No. 172 of 2012, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
