Why are dowry laws needed ? = why is castration needed ??



When someone talks about the Rampant misuse of Dowry law, how innocent mothers and sisters have been arrested, the common refrain is .... why were dowry laws needed ?? meaning men were these barbarians and you needed strict laws to tame them ...

so, WHY ARE DOWRY LAWS NEEDED? ????  ...that sounds the same as WHY is castration needed ???? 

After a few thousand men innocent men have been castrated chemically and incarcerated for decades we will be having the same jolly good debate on "tut.." ..."tut" ...."...minor miscarriage of justice ..." and why was castration needed ???? it all because some one had a ........ !

The technique here is to start the debate at a level where
      - the total barbaism of castration,
      - the  corropution in police,
      - 10s of 1000s of false cases in India

The Bombay High Court has taken into account a cop’s income from sources other than his salary to grant his estranged wife’s demand for monthly maintenance, after she told the court he brought home nearly Rs 50,000 a month in bribes. Constable Sainu Virkar of Thane police will now pay his wife Shobha Rs 16,000 a month, which is a little more than his monthly take-home, official that is.

Though Virkar refuted his wife’s claim about his ‘other sources of income’ and demanded that she produce proof, Justice Roshan Dalvi went by the public perception of government servants such as police officers being corrupt.

“It may be that proceedings under the Prevention of Corruption Act may or may not have been initiated against the petitioner (husband), but upon a specific plea of the wife, and given the nature of public officers like police officers who are seen to be corrupt, those statements cannot be brushed aside, at least for the benefit of the petitioner,” the judge observed.

Justice Dalvi was hearing Virkar’s plea against a family court’s order, directing him to pay his wife an interim monthly maintenance – Rs 8,000 for her own needs and Rs 4000 each for that of their two teen-aged children. Virkar and his wife are locked in a bitter divorce battle since May last year when she filed a divorce petition in a Thane family court through advocate Ravindra Sankpal. The petition was later transferred to the Bandra family court.

Virkar countered his wife’s divorce petition by filing his own demanding restitution of conjugal rights in July last year.

Virkar’s petition in the high court said his monthly salary is Rs 26,278 per month and that after various deductions, he takes home Rs 15,822, which is Rs 178 less than the maintenance he must now pay his wife.

The family court’s order came in July. Though the family court had rejected Virkar’s wife’s contention about his ‘extra income’ in absence of any proof, it upheld her demand for maintenance. The family court had then observed, “There is no proof that he is involved in illegal practices. Even if it is assumed that he is, it is the duty of the petitioner (his wife) to inform the Anti Corruption Bureau about the same.”

The family court had also rejected Virkar’s wife’s claim that he annually earned Rs 4 lakh from a piece of agricultural land in Satara.

In his appeal in HC seeking a lower maintenance amount, Virkar had also showed expenses like society maintenance, electricity bills and home loan repayment.

However, the high court refused to accept these arguments. The court observed that he had not produced any agreement for the EMI amount. It also said that while the flat was purchased in 2004, the application for home loan was made only in April last year, just a month before his wife filed for divorce.

On the electricity bill, the court observed that his monthly spend of Rs 1220 was rather high for an income of just under Rs 16,000. “The petitioner is seen to live comfortably and is also seen to manipulate his salary sheet,” the judge said.

Virkar, who has filed an appeal against this order through advocate Dinesh Kadam, said he has done his best for the upkeep of his estranged wife and two children.

The Congress party is firming up a draft Bill on tackling crimes against women for submission to the Justice Verma Committee. This will suggest stringent punishment of up to 30 years for rape convicts, and include a provision for chemical castration. It is reliably learnt that the draft of the Bill has largely been finalised and shown to Congress president Sonia Gandhi, who is keen that the party adopts a proactive approach is firming up an effective legislation at the end of the Verma committee’s month-long exercise.
The three-member committee headed by former Chief Justice J S Verma has been appointed by the government to review existing laws and suggest changes that would ensure faster justice and stringent punishment in cases of crimes against women. Working on a 30-day deadline, the committee has already sought public comments and suggestions by January 5. Other members of the committee include Justice (retd) Leila Seth and former solicitor general Gopal Subramanian.
The party’s intention, sources said, is to press the government to issue an ordinance instead of calling a special session of Parliament once the committee has made its recommendations. While the final course of action will be firmed up in the days ahead, the understanding within the party is that at most the government can call for an all-party meeting to obtain the sense of political parties.
For now, however, the Congress is busy working on firming up its contribution the Verma Committee. The draft bill is to be called Prevention of Sexual Atrocities Against Women Bill. While the party is tight-lipped about the details, the key provisions are:
* Up to 30 years imprisonment for rape convicts without any parole.
* Chemical castration as one of the punitive measures.
* Setting up of fast-track courts with a 90-day deadline to finish proceedings.
The bill, which was drafted by a group of Congress leaders including a few Cabinet ministers, will get its final approval from the Congress core group, which was to meet today to take stock of the situation after the death of the rape victim in Singapore. Sonia Gandhi has been calling for a strong response to the ghastly gangrape in Delhi and has been in regular touch with the government on the case.

Explanation.—In this section “sexual intercourse” shall mean any of the acts mentioned in clauses (a) to (c) of section 375 of the Indian Penal Code.’

Mumbai"Tumhara chehra rape ka FIR karne layak nahin hain." A woman who turned to the cops to lodge an FIR against a man who had duped her into a live-in relationship was turned away by a female police officer on the pretext of this bizarre rationale.

The cop went on to sanctimoniously tell her that if she had truly loved the man who wronged her, she wouldn't lodge a complaint against him, but would marry another man and live happily ever after.

Before receiving such pearls of wisdom from the female cop, the complainant had even been told by a senior inspector that there was "no point" in lodging a rape case.


Rekha, (name changed) a 28-year-old resident of Malad, had moved in with her boyfriend after he promised he would marry her.

After he dumped her unceremoniously and married another woman years later, she turned to the police. For four consecutive days, police officers refused to register an FIR, saying 'saheb chhutti par hain."

She then met Senior Inspector Subhash Dafle, who also refused to register an FIR and assured her that all would be fine in a few days.

"Dafle told me, 'Rape ka FIR karne me koi fayda nahin hai. Char din me sab theek ho jayega. Rapist to Goregaon- Malad me chhipa nahin hai ki use pakad layein (There is no use filing an FIR for rape. Everything will be fine in four days. It's not like the rapist is lurking in Goregaon or Malad that we can catch him)," said Rekha.

Faced with the blunt refusal of cops, Rekha approached the Borivili Magistrate Court on December 15 with the help of lawyer Ashok Yadav.

The court then passed an order asking that an FIR be registered against Santosh Sharma under Sections 376, 406, 420 and 498 (A) of the IPC for dowry, rape, cheating and breach of trust.

But even the court's order couldn't convince the cops to take action.

"The honourable court passed an order asking the police to register an FIR on the same day, but Kurar police turned a deaf ear. They aren't even obeying the court's order," said Yadav.

Armed with the court order, Rekha met officer Jyoti Bhopale with the court order. But instead of registering the FIR, Bhopale started giving her some unsolicited advice, replete with veiled insults.

"She told me, 'Tumhara chehra rape ka FIR karne layak nahin hai. Agar tum usse sachcha pyar karti to uske khilaf complaint nahin karti. Jao kisi aur se shadi kar lo aur khush raho(Your face doesn't merit a rape FIR. If you loved him truly, you would not lodge a complaint against him. Go marry someone else and stay happy)," said an outraged Rekha.

False promises

Rekha met Santosh Sharma (30) at a garment shop in 2006 and they soon became friends. They started living together. Sharma even introduced Rekha to his family as his 'wife'. Sharma would give Rekha Rs. 8,000 every month. Rekha would even give part of her salary to Sharma's father. In 2009, Sharma went abroad for a job. He then started distancing himself from Rekha, and stopped communicating with her. When he was confronted, he refused to tie the knot with her, saying that he couldn't do so as he was a heart patient.

"Sharma told me, 'Main heart ka patient hun isliye shadi nahin kar sakta,'" said Rekha.

In March, Rekha went to Sharma's native district in Unnao, Uttar Pradesh. She was shocked when police officers and villagers told her that Sharma had married another woman.

Sharma's father Guru Dayal Sharma told Rekha that since she couldn't pay him Rs. 2.5 lakh in cash and give four tolas of gold, he made his son marry another woman. "Santosh swore on his mother's life that he didn't know me," said Rekha.

The other side
In spite of repeated attempts, Senior Inspector Dafle of Kurar police station could not be reached for comment. "I am not aware about the court order, but I will look in to the matter," said Nisar Tamboli, spokesperson for the Mumbai Police.

Girl fined for false rape charge

Islampur, Sept. 26: A fast-track court today fined a 19-year-old girl for filing a trumped-up rape case against a youth who had to spend three months in jail.
According to sources in the court, the complaint was lodged on June 4, 2010, at the Chakulia police station by the girl, who was then 17 years old.
She had alleged that the youth had raped her around 4am when she was out for a walk.
The youth was arrested and remanded in judicial custody. He had spent 87 days behind bars. He was granted bail by the court in course of the hearing.
During the trial, the court heard the police as well as the physician who had conducted a medical test. The sources said that the medical test did not show that the girl had been raped.
Yesterday, the girl and her farmer father were called to court.
The father owned up in court that the charges were trumped up.
"I think that my daughter had made up the charges against the youth at someone's provocation," the father told the court. The girl too conceded that she had brought false allegations against the youth, who lives in the same village as her.
After the judgment, the youth said: "This girl had been asking me to marry her and when I refused she brought the false charge against me."
Judge Subhasis Ghosal berated father and daughter and made them apologise to the youth.
He said that since both had owned up and regretted their actions, he would not start proceedings against them. He imposed a fine of Rs 3,000. He also said that such cases were also a waste of time of the court.
The fine was handed over to the youth through the court today.
"My client has been cleared of the slur that was brought against him. I am happy that justice has been done," his lawyer Feroz Ahmed said.
The youth, who sells in vegetables and paddy, said he was relieved that his name had been cleared.
Kaizer Chowdhury, the public prosecutor, said that the case was an important one.
"This verdict will go a long way in making people aware that one cannot get away by slapping false charges. I hope this case will help stop people from filing false cases and wasting the time of the court," he said.
"For two years I have been suffering mentally as I was ostracised and I had to do time in jail. Even my family looked down on me. I am now happy that the court has cleared my name," the youth said.

A quarrelsome, evidently frustrated bully by day and a volatile brute enslaved by a fetish for drunken sexual gratification and innate misogyny by night. The Dr. Jekyll and Mr. Hyde trapped inside 33-year-old Ram Singh's average frame, officers interrogating him said, seem to supplement
instead of balancing each other out.
He is known as 'Mental' to residents of each home located along the serpentine bylanes of RK Puram's Ravi Das Camp slum cluster. In fact, Singh was ferrying impressionable school children for a living on the basis of a driver's licence fraudulently obtained from Rajasthan. Not to mention his deformed arms because of an accident at Andheria More in 2009, and mental make up. Singh has confessed to having physically assaulted even his mother during a bitter quarrel two months ago.
This, police said, prompted his father to leave the city for his ancestral village in Rajasthan and made his family of seven fall apart. Two of Singh's brothers moved away and another decided to stay back in the colony but severed ties with him.
"In 2009, Singh had eloped with a married woman from his locality. Whenever his mother would pull him up for it, he would listen without interest during the day before returning heavily drunk. He would wake her up in the middle of the night and quarrel with her,” an officer said, quoting what Singh told police during questioning.
A neighbour, 34-year-old Shanu, concurred, "Their house used to ring with cuss words every single night. One night, however, he crossed all limits when he pulled his mother by her hair and threw her out of the house. No one looked him in the eye after that."
The apparent streak of violence that seemingly characterised him elicited two strict instructions from his neighbours both for women and children staying in the locality. One was not to look him in the face or react whenever he passed a lewd comment. And the other to stay clear of him and his house after dark.
An officer said while the other arrested accused often break down but Singh doesn't even bat an eyelid.
"Such brutality isn't natural or even possible for a first-time offender,” the officer added.

Nicole Hawkins‘ three daughters have matching glittery boots, but none has the same father. Each has uniquely colored ties in her hair, but none has a dad present in her life.
As another single mother on Sumner Road decked her row-house stoop with Christmas lights and a plastic Santa, Ms. Hawkins recalled that her middle child’s father has never spent a holiday or birthday with her. In her neighborhood in Southeast Washington, 1 in 10 children live with both parents, and 84 percent live with only their mother.
In every state, the portion of families where children have two parents, rather than one, has dropped significantly over the past decade. Even as the country added 160,000 families with children, the number of two-parent households decreased by 1.2 million. Fifteen million U.S. children, or 1 in 3, live without a father, and nearly 5 million live without a mother. In 1960, just 11 percent of American children lived in homes without fathers.
America is awash in poverty, crime, drugs and other problems, but more than perhaps anything else, it all comes down to this, said Vincent DiCaro, vice president of the National Fatherhood Initiative: Deal with absent fathers, and the rest follows.
People “look at a child in need, in poverty or failing in school, and ask, ‘What can we do to help?’ But what we do is ask, ‘Why does that child need help in the first place?’ And the answer is often it’s because [the child lacks] a responsible and involved father,” he said.

The spiral continues each year. Married couples with children have an average income of $80,000, compared with $24,000 for single mothers.
“We have one class that thinks marriage and fatherhood is important, and another which doesn’t, and it’s causing that gap, income inequality, to get wider,” Mr. DiCaro said.
The predilection among men to walk away from their babies is concentrated in the inner cities. In Baltimore, 38 percent of families have two parents, and in St. Louis the portion is 40 percent.
The near-total absence of male role models has ripped a hole the size of half the population in urban areas.
Tiny selfless deeds trickle in to fill that hole as the natural human desire for intimacy is fulfilled: One afternoon last week as a girl hoisted a half-eaten ice cream sandwich high over her pigtailed head, Larry McManus, the father of the girl’s sister, bent down to eat out of her hands as he picked up the girls from school.
“I know dads that say they ain’t their kids. I see dads being disrespectful of the mothers. And I see ones who take other men’s kids to football games because they know their fathers aren’t around,” said Mr. McManus, an ex-felon who said he is “trying to make a lot of changes right now.”
Asked his daughter’s age, he consults with her sister.
“Five. She’s in pre-K,” the girl answered.
“She’s 5,” he echoed. “Mmm, that was good,” he said gently of the ice cream sandwich. “Can I have another bite, please?” 


Racial divide

Though income is the primary predictor, the lack of live-in fathers also is overwhelmingly a black problem, regardless of poverty status, census data show. Among blacks, nearly 5 million children, or 54 percent, live with only their mother. Twelve percent of black families below the poverty line have two parents present, compared with 41 percent of impoverished Hispanic families and 32 percent of poor white families.

The schism is most apparent in the District, which has a higher portion of two-parent families among whites, at 85 percent, and a lower share among blacks, at 25 percent, than any state.

In all but 11 states, most black children do not live with both parents. In every state, 7 in 10 white children do. In all states but Rhode Island and Massachusetts, most Hispanic children do. In Wisconsin, 77 percent of white children and 61 percent of Hispanics live with both parents, compared with more than 25 percent of black children.

“Something has to be done about it, and it starts with the culture and reversing the attitude that marriage is not important. The president has a role to play in that. He’s a married African-American father who can probably make a huge difference with words alone,” Mr. DiCaro said.

But the move toward single-parent homes has included every race, and from Curtis Bay in Baltimore to Millcreek outside Salt Lake City to Vancouver, Wash., just north of Portland, there are 1,500 neighborhoods with substantial white populations where most white households lack fathers. Maine, Vermont and West Virginia have the lowest dual-parenthood rates for whites. 

Southern cross

The decline has hit disproportionately in the South, which considers itself a bastion of traditional family values.

Even in places where the percentage of the black population declined, single parenthood increased over the past decade, The Washington Times’ analysis of census data shows. In South Carolina, where the black share of the population fell by 2 percent, single parenthood rose by 5 percent. In Kentucky and Louisiana, where the black population was constant, single parenthood increased 6 percentage points.

“In places you’d think values are at least talked about, they are not lived out necessarily. Education and income seem to trump them. The people who might not be preaching family values, like coastal upper-class communities, those are the people who are waiting to get married,” Mr. DiCaro said.

The largest geographic area of sustained fatherlessness contains the rural, largely black poor across Arkansas, Mississippi and Louisiana, tributaries of broken homes running 400 miles along the Mississippi River from Memphis, Tenn., where in some neighborhoods 82 percent of children live with their mothers alone, to Baton Rouge, La., in parts of which less than one-fifth of children have both parents at home.

Black families differ from other racial groups in that the average black single mother has more children, not fewer, than her counterpart with a father present. Hispanic single mothers were most often dealing with the most mouths to feed but still had fewer children than their married counterparts. 

To have and to hold

Mr. DiCaro points to a desire among the poor to produce something.

“When you have very little going for you in your life, having children can give purpose to it. If you’re married, you’re going to be much more cautious. There’s health care costs and our jobs, whereas if we were both just kind of doing whatever, then why not just have another kid?”

Mr. McManus is quick to blame the absence of fathers to deaths or incarcerations, though women point out that many absent fathers live around the corner. Mr. McManus attributes that to the young age of many parents who are not ready to be “tied down.” He said women who need help with their children will seek the companionship of other men who they think can be father figures.

Ms. Hawkins, the mother of three, lives with her youngest child’s father but considers herself a single parent.
“When he’s home, he’s watching TV; it’s his time. I get no help. Financially, he’s been a good provider,” she said, even for the children who aren’t his. But “as far as being involved in activities, not so much.”
Her relationship with her eldest child’s father ended over his refusal to support their offspring, and her second child’s father is in prison.

“My oldest was raised by both parents, so it’s just selfish,” she said, but “my middle one, he wasn’t raised by either parent, so he doesn’t know how.”

“We need more fatherhood initiatives,” she said, pointing to government- and nonprofit-funded programs at churches, prisons and community centers, such as those offered by Mr. DiCaro’s group, “so they can see what they’re missing.”
Just then, her daughter Nadya picked up a tree branch and strummed it like a guitar, jumping up and down, all smiles. Ms. Hawkins reconsidered her thoughts on government programs.

“Though to me, that’s the initiative right there,” she said. “You can talk till you’re blue in the face about how to do it, but ultimately, you just have to do it.”
