Abitha hails from Nagerkoil in Tamil Nadu. She married Eben Jeyenthiran in 2001. in 2002, Eben Jayanthiran filed a divorce petition stating that Abitha was mentally ill / psychiateric. Abitha did NOT attend the proceedings in spite of notices being served. So in 2002, the local court decreed a divorce ex parte
In 2009 (yes seven years after the decree) Abitha appealed at the Nagerkoil sessions court, against the lower court decree stating that she was unaware of the divorce and so her delayed appeal should be allowed. The Nagerkoil sessions court dismissed Abithas appeal !!
Abitha continued with an appeal the the Madras High court
Eben Jeyandiran also submitted a counter to that stating that Abitha had NOT appeared for proceedings, and that after the decree Eben was married and had kids from the next marriage
However the chennai HC said that courts should help litigants, and such (original decrees) are like pouring oil on burning fire .... !! The Honourable High court set aside the original divorce decree and asked Abitha and Eben Jeyandiran to start divorce proceedings all over again !!!
