Sexual harassment: It's time to move on, HC tells parties

MUMBAI: The Bombay HC on Thursday sought a solution to resolve the sexual harassment case filed in 2007 against KPMG (India) Limited by a former associate director, telling both sides that it is time move on.
Justices V M Kanade and Anil Menon's observations came after the complainant concluded her arguments, saying the National Commission for Women has jurisdiction to entertain individual complaints and even "took cognizance of the Tarun Tejpal case".
The court heard the multinational's petitions to quash proceedings initiated by NCW last year, saying it is not an adjudicatory body but can only recommend. The HC in November 2013 had stayed the proceedings.
The complainant argued that she had exhausted all remedies available in law as every proceeding was challenged and justice to her was delayed. She said the NCW hearing is also stalled by the present petition by KPMG. "It has been eight years," she said. The judges said litigation will go on for long and as the complainant is a qualified chartered accountant, she should concentrate on having a better future with better job prospects. "You have to look ahead," said Justice Menon. The complainant said she is not employed and has been fighting not for monetary gains but for the dignity of women. "No one should suffer like me. More than anything, my professional dignity must be maintained," she said.
The HC judges said they are interested in finding a solution to amicably resolve the dispute.
KPMG's advocate Nikhil Sarkhardande said he will take instructions and inform the court if his client is willing to abide by the court's mediation.
The complainant also said, "I am willing to explore the possibility (of a settlement)." The judges told them to decide on a convenient date.
